TRADING TERMS AND CONDITIONS
In these terms:
- ‘We’, ‘Us’, or ‘Our’ means Bespoke Sales Limited.
- ‘You’, ‘Your’ or ‘Customer’ means the person using the Site to buy goods from us.
‘Site’ means www.mypooldirect.co.uk and any other website owned and/or managed by or on behalf of Bespoke Sales Limited.
- HOW ARE YOUR PAYMENTS DEALT WITH?
All of Your payments for products purchased within our online store are accepted exclusively in GBP and are dealt with by either Credit Card / Debit Card, Paypal, Cheque, or Bank Transfer. For confirmation of the types of payments and cards accepted, please refer to the bottom of the Front Page of the Site.
- Secure Payment System
We use a secure online payment system for all Credit and Debit Card payments. All Your payments are safe and secure with this method of payment.
Payments are generally paid for in full if the item is an ‘off the shelf’ product ready for immediate delivery. We may, in our absolute discretion, however accept non-refundable deposits of between 50%-75% of the full purchase price in relation to any orders for Bespoke pools, enclosures and other items produced to specification, with the remaining balance payable when confirmation has been received from the factory of dispatch to the Customer’s address.
- Refunds and Cancellation
In relation to products sold within the EU, the Customer has the right to cancel their order within 14 days of the order being received by Bespoke Sales Limited and is entitled to a full refund. To exercise this right, You must inform us of Your decision to cancel this contract by a clear statement (e.g. a letter sent by post or email).
In relation to products sold outside the EU, any refunds offered are at the absolute discretion of Bespoke Sales Limited.
In relation to products sold to trade customers, no refunds shall be available.
- GENERAL TERMS AND CONDITIONS:
These terms and conditions help to keep the Site a safe place to trade and set out the full extent of any agreement reached between You and Us in connection with the Site and order placed using it. All Online checkout prices are Nett and vat @ 20% will be added on checkout. You should understand that by placing an order, You accept the following terms and conditions:
- It is Your sole responsibility to arrange and pay for Crane hire if required for Unloading, or to ensure adequate man power is on site to remove materials from the transporter at kerb side to site as applicable.
- It is Your sole responsibility to ensure that in the case of pools the concrete base is a minimum of 16cms thickness and contains steel mesh, and that it is 100% flat and level across the total base of the hole. Where pools are built on site the area excavated (the hole) must be a minimum of 2 metres larger than the external measurements of the pool, This is required to enable any workers engaged in installation to walk around the pool, and use welding equipment and for the back filling process to take place.

- The ground preparation prior to delivery of One Piece Pools or pending on site installation by Our teams. The Base must be adhered to as per point 2 above. This must be complied with and agreed in writing to us prior to Your installation. This is because on arrival Our teams must start work without any delay in building Your pool, should the base not be flat and level it may mean Our team will no be able to complete the work and as a result have to return at a later date. In doing so further charges would be incurred. This needs to be followed as the pool warranty is based on the pool standing on a flat level surface this covers both You and Your purchase and Us.

Your contract for purchases made through the Site is with Bespoke Sales Limited and You undertake that any and all goods ordered by You are for Your own private and domestic use only unless otherwise stated and agreed with Us in writing.
No contract for the sale of any product will subsist between You and Us unless and until We accept Your order by way of an e-mail confirming that We have received payment in full for all the goods You have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to You at the time We sent the e-mail to You (whether or not You receive that e-mail). This confirmation e-mail amounts to an acceptance by Us of Your offer to buy goods from Us or a third party supplier engaged on Our behalf This confirmation e-mail will contain all relevant statutory information concerning Your contract. You must check that the details on this confirmation e-mail are correct as soon as possible and You should print out and keep a copy of it. We will not pass on Your personal or credit or debit card details to any third party and We will at all times comply with Our obligations under the Data Protection Act 1998. You undertake that all details You provide to Us for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card You are using is Your own and that there are sufficient funds to cover the cost of the goods or services You have ordered. If there are any changes to the details supplied by You it is Your responsibility to inform Us as soon as possible. Your statutory rights are not affected but otherwise all purchases are non-exchangeable, non-refundable and non-transferable.
- Delivery and Inspection:
Neither Bespoke Sales Limited nor any of its suppliers are responsible for delayed deliveries caused by road conditions, traffic accidents, vehicle breakdowns, ferry disputes or any other circumstance beyond their reasonable control. If delivery is delayed for any reason, we will notify You of a revised delivery date as soon as practicably possible.
Any unloading from vehicles is the sole responsibility of the Customer and under no circumstances will Bespoke Sales Limited or its suppliers become involved in the unloading process at any stage.
Every delivery must be inspected for possible damages as soon as practicably possible and details of any and all damages must be provided in the transport documents. Clear photographic evidence will also be required.
Every incident or example of damage to delivered products must be reported in writing to Bespoke Sales Limited immediately.
Damages reported later than 24 hours after delivery will not be considered in relation to any warranty claim.
Bespoke Sales Limited does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services in its absolute discretion. We will do our best to correct errors and omissions as quickly as practicably possible after being notified of them.
To the fullest extent permitted by law, Bespoke Sales Limited makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to the Site or the information, content, materials or products included in the Site including, without limitation, warranties of suitability and fitness for a particular purpose. In addition, Bespoke Sales Limited does not represent or warrant that the information accessible via the Site is accurate, complete or current.
Bespoke Sales Limited does not accept liability for any indirect or consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from the Site. We will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.
- Processing of Orders
Credit and Debit cards are debited using a secure payment facility items and are shipped by Bespoke Sales Limited. All prices include sales taxes (where applicable) unless otherwise stated. Bespoke Sales Limited aim to arrange shipment of all in stock items within 10 working days of receiving Your order. Your order may be delayed if the item is not in stock. Some items may be unavailable and the current stock status is always approximate. The period stated within which You will receive Your order is also approximate. Goods will be sent to the address given by You in Your order and stated in the order confirmation email.
Title to any product ordered will pass to You once Bespoke Sales Limited has received payment in full for that product. If Your delivery address is outside of the UK You may be subject to import duties and taxes, which are levied once a shipment reaches Your country. Any such additional charges for customs clearance must be borne by You. You should note that customs policies vary widely from country to country; Bespoke Sales Limited advises each customer to contact their local customs office for further information. Please note that when shipping products internationally You should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
Some products are out sourced therefore delivery dates quoted are approximate only. Any delays that may occasionally occur are beyond our control.
It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Bespoke Sales Limited tracks the electronic ‘fingerprints’ of every order placed on Bespoke Sales Limited to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on the Site. Bespoke Sales Limited may amend these terms and conditions from time to time, and place the new version on the Site. When Bespoke Sales Limited does so, We will mention the fact on our home page on our sites. All purchases from the date that the amended terms are placed on our website on-wards will be governed by those new terms. These terms and conditions shall apply when Bespoke Sales Limited accepts Your order by e-mail confirming that it has received payment in full for all the goods You have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to Your purchase, whether oral or in writing, and contain the entire agreement between Bespoke Sales Limited and You relating to Your purchase. Bespoke Sales Limited advises that You print off and keep safe a copy of these terms and conditions once Your order has been accepted by Bespoke Sales Limited. You are advised to read (and are responsible for reading) all information on this website fully. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain. These terms and conditions are subject to the laws and exclusive jurisdiction of the UK.
When making a purchase Your details and personal information will be safe at all times on our secure server (data protection). There are no membership fees or subscription fees on this site. We will always adhere to the Consumer Protection (Distance selling) Regulations 2000 and the Electronic Commerce (EC Directive) Regulations 2002.

Intellectual Property and Conditions of Website Use
Ownership of any and all intellectual property rights (including copyright and trade marks) in any element of the Website, including but not limited to its design, text, graphics, the selection and arrangement thereof and all software compilations, underlying source code, software (including applets) and all other material vests in Bespoke Sales Limited, and its affiliates or their content and technology providers. All such rights will be enforced without notice. Any use of materials on this Web site–including reproduction for purposes other than those noted above, modification, distribution, or re-publication–without the prior written permission of Bespoke Sales Limited is strictly prohibited.
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
we will collect the goods without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired;
